A foreclosure is a very complicated, very technical lawsuit. It involves the full gamut of issues – the Florida Rules of Civil Procedure, the Florida Code of Evidence, federal laws such as the Real Estate Settlement Procedures Act, the Truth in Lending Act, and the Fair Housing Act, state case law (which is always changing as new cases are decided), and finally local administrative rules and orders. The laws around foreclosure are changing all the time.

Unless you have hundreds of hours to dedicate to learning the rules, monitoring the case law developments and staying on top of all the administrative orders, you would be better served by hiring a lawyer to represent you in your foreclosure case. If you make just one mistake, it could cost you your home.

Most clients who come to us recognize that they need a lawyer, but they are concerned because they don’t think they have the money to pay for one. We offer our clients a low, monthly fixed rate fee while we defend their foreclosure lawsuit. We made our fee deliberately low so that almost anyone could afford us. We don’t want you to try to fight the banks alone because you can’t pay a lawyer to take your case.

Just as the foreclosure laws are changing, so too are the rules around who qualifies for a loan modification. On an almost monthly basis, the government issues new supplemental directives to its Home Affordability Modification Program (“HAMP” or simply the “Obama Plan.”) Our lawyers and staff monitor these supplemental directives on a regular basis and help our clients prepare their loss mitigation documents accordingly. We have a flat fee for preparing our clients’ files for mediation and representing them at the mediation table. The bank is required to have a lawyer at mediation. You should have one as well!
